Agreement for the use of the learning platform
of MICROTARIANS Sàrl-s SIS
 
§1 Fields of application
(1) This user agreement applies to the use of the learning platform, including all content and web pages present. By using the platform, the user expressly accepts these terms of use without further explanation.
 
§2 Availability
(1) The services are offered to the user subject to availability. MICROTARIANS Sàrl-s SIS endeavours to ensure that the services are available to the user without interruption.
(2) Due to maintenance work and/or further developments and/or other disturbances, the possibilities of use may be limited and/or temporarily interrupted. This may also lead to a loss of data under certain circumstances. This does not give rise to any claims for compensation from the users concerned.
 
§3 Obligations of the user
(1) Compliance with applicable legal provisions: The user undertakes not to violate applicable legal provisions.
(2) In particular, he/she undertakes to ensure that the content he/she distributes does not infringe the rights of third parties (such as copyrights, patent and trademark rights);
- the applicable criminal laws and regulations for the protection of minors are observed;
- no racist, pornographic, obscene or offensive content or content unsuitable for minors is disseminated.
(3) Obligation in dialogues: When using dialogue-oriented content on the website, the user undertakes to restrict himself to the professional exchange of opinions, to refrain from advertising statements and to show consideration for the interests of other participants.
(4) MICROTARIANS Sàrl-s SIS is entitled in particular to delete contributions which, due to their choice of language or content, do not comply with the rules of fair discussion and morality or do not show sufficient consideration for the interests of other participants. The assessment of MICROTARIANS Sàrl-s SIS is decisive for the classification of the contributions. MICROTARIANS Sàrl-s SIS hereby expressly prohibits in particular the posting of racist, pornographic, obscene, inhuman or immoral material.
(5) Access data and password: The user undertakes to keep all access data allocated to him/her secret and not to pass them on.
(6) Each user is responsible for all activities that occur under his or her password.
In the event of misuse or loss or any suspicion thereof, MICROTARIANS Sàrl-s SIS must be notified immediately using the following e-mail address: info@microtarians.com. Any indications of misuse of the services and contents of MICROTARIANS Sàrl-s SIS must also be reported immediately to the above e-mail address. MICROTARIANS Sàrl-s SIS is entitled to block access if, through the fault of the user, the access data is misused, e.g. by transmitting it on to third parties or other users.
 
§4 Liability and contents
(1) Liability for links. MICROTARIANS Sàrl-s SIS accepts no responsibility for the content of linked websites. Insofar as MICROTARIANS Sàrl-s SIS provides a link, it hereby expressly declares that no illegal content was discernible on the linked pages at the time the link was created. This declaration applies to all links on this website as well as to those in guest books, discussion forums and similar services set up by MICROTARIANS Sàrl-s SIS, the content of which can be accessed and edited from third-party. In no event shall MICROTARIANS Sàrl-s SIS be liable for the content of websites that refer to MICROTARIANS Sàrl-s SIS. MICROTARIANS Sàrl-s SIS is also not in the position to determine or check references to its websites.
(2) Liability for third-party content: In the case of content from third parties as well as from private individuals (in particular in discussion forums and chats), the website merely makes the medium technically available.
Such content made available to the user by third parties is information provided by the corresponding author or distributor and not by MICROTARIANS Sàrl-s SIS. MICROTARIANS Sàrl-s SIS is therefore not responsible for the accuracy, correctness or reliability of such content under any circumstances. In particular, MICROTARIANS Sàrl-s SIS shall not be liable for any loss or damage suffered by the user as a result of relying on such information.
(3) Furthermore, MICROTARIANS Sàrl-s SIS has no influence on how the contents offered here are used by the user and can therefore not be held liable for any damage incurred, lost benefits or other direct or indirect consequences arising from the use of the contents offered here.
(4) Despite regular data back-up measures, no guarantee can be given for data entered from users nor for work results of the users. Liability for loss of data is therefore excluded.
(5) MICROTARIANS Sàrl-s SIS excludes any liability for technical or other malfunctions.
 
§5 Copyright
(1) All content published on the MICROTARIANS Sàrl-s SIS website, such as text, images, graphics, sound, video and animation files, as well as databases, are protected by copyright. Reproduction and dissemination of the content is not permitted.
(2) The use of the contents is only permitted for private personal use. Any use beyond this requires the prior consent of MICROTARIANS Sàrl-s SIS; this applies in particular to the commercial and private reproduction, modification, distribution or storage of information or data, in particular of texts, parts of texts and image material.
(3) In all other respects, the statutory limits of copyright and/or other applicable legal provisions shall apply.
(4) The user undertakes not to disclose his login data to any third party and assumes full responsibility for everything that is entered via this login.
 
§6 Data protection
(1) By registering, the user agrees that collected data may be stored for internal administration and processed anonymously for statistical purposes.
(2) Personal data will not be disclosed to third parties unless it is the express wish of the user (e.g. learning results and goals for further educational or vocational measures).
(3) The user undertakes not to transmit his/her password to third parties.
 
§7 Further provisions
(1) Only Luxembourg law applies and the Luxembourg court has jurisdiction.
(2) Should individual provisions of the terms of use be invalid or lose their validity due to a circumstance occurring at a later date, the validity of the rest of the contract remains unaffected.
